ZMOD, LLC ("ZMOD", "we", "us", or "our") provides gaming services under these Terms of Service.

By accessing and using our services, including our Garry's Mod servers, website, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

We provide gaming services, primarily focused on Garry's Mod servers and related content. Our services include but are not limited to:

• Access to our Garry's Mod game servers
• In-game purchases and virtual items

• Support portal for user assistance and ticket management
• Integration with Steam and Discord services

2.1 Monetization Services

We provide monetization services in partnership with:

• Tebex - Our primary payment processing and game server monetization platform
• PayNow - Additional payment processing services for game server transactions

3.1 Account Creation

Our services utilize Steam for primary account authentication. You must have a valid Steam account to access our services. Additionally, you may link your Discord account to access enhanced features and community integration. By using our services, you agree to:

• Authenticate using your Steam account
• Optionally link your Discord account for additional features
• Provide accurate, current, and complete information during the account linking process
• Update such information to keep it accurate, current, and complete
• Comply with both Steam's and Discord's terms of service where applicable

3.2 Account Security

You are responsible for maintaining the security of your Steam account and any linked accounts (such as Discord). You agree to accept responsibility for all activities that occur under your accounts while using our services. This includes maintaining secure passwords, enabling two-factor authentication where available, and promptly reporting any unauthorized access or security issues.

3.3 Account Access and Lost Items

All benefits and items are tied to the specific account used to access our services. We are not responsible for:

• Items or benefits lost due to losing access to your Steam account
• Items or benefits lost due to account bans or suspensions
• Transferring items or benefits to new or different accounts
• Replacing or restoring items if you can no longer access your account

When using our Services, you agree not to:

• Violate any applicable laws or regulations
• Use cheats, exploits, automation software, or any unauthorized third-party software
• Harass, abuse, or harm other users
• Interfere with or disrupt the Services or servers
• Engage in any form of fraudulent activity
• Share or distribute inappropriate or offensive content
• Trade or exchange in-game items for real-world value
• Exploit pricing errors or technical glitches
• Use unauthorized methods to access or modify services
• Attempt to circumvent any service restrictions or limitations

All content included in or made available through our Services, including text, graphics, logos, images, and software, is our property or that of our content suppliers and is protected by international copyright laws.

5.1 Code and Asset Protection

All code, scripts, addons, modifications, configurations, and digital assets created by or for us are proprietary intellectual property protected under the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws. This includes but is not limited to:

• Server configurations and settings
• Custom addons, scripts, and modifications
• Game modes and their associated code
• Custom textures, models, and visual assets
• Database schemas and configurations
• Website code and design elements
• Any other proprietary software or content

5.2 Prohibited Use

You are strictly prohibited from:

• Distributing, reproducing, or sharing any of our code or assets outside of our official servers
• Reverse engineering, decompiling, or disassembling our proprietary code
• Creating derivative works based on our intellectual property
• Using our code or assets for any commercial purposes without explicit written permission
• Hosting or operating servers using our proprietary code or configurations
• Attempting to extract, copy, or replicate our server setups or configurations

5.3 DMCA Protection

All of our intellectual property is protected under the Digital Millennium Copyright Act (DMCA). Any unauthorized use, distribution, or reproduction of our code or assets constitutes copyright infringement and may result in:

• Immediate termination of your access to our services
• Legal action for copyright infringement
• DMCA takedown notices to hosting providers
• Pursuit of damages and injunctive relief

We reserve the right to terminate or suspend access to our Services, without prior notice or liability, for any reason whatsoever, including but not limited to:

• Any breach of our Global Server Guidelines or server-specific guidelines

In cases of serious violations, termination will be immediate and permanent, with no eligibility for future access. While we have an appeal process available, appeals can still be denied at our discretion.

We reserve the right to modify or replace these Terms at any time. Changes will be effective immediately upon posting of the updated Terms on our website. The "Last Updated" date at the top of these Terms will reflect when changes were made. Your continued use of our Services after any changes to these Terms constitutes your acceptance of such changes. It is your responsibility to regularly review these Terms to stay informed of updates.

In no event shall we, nor our directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

By submitting any videos, images, media, or suggestions/feedback through our Discord server, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content for any commercial or promotional purposes, including but not limited to social media marketing, website content, and advertising materials.

9.1 Media Participation

By participating in our services, including but not limited to joining our in-game servers, voice chats, or Discord servers, you acknowledge and agree that:

• You may appear in media content created by us or our community
• Your voice communications may be recorded and used in our content
• Your username, avatar, and other public information may be visible in our media
• Such content may be used for commercial and promotional purposes

If you wish to request the removal of any media you have uploaded or that has been reused, please contact [email protected]. We will review all takedown requests and respond within a reasonable timeframe.
